HMS Customer Privacy Policy

This privacy policy was last updated on Dec 12, 2018.

At HMS Industrial Networks we place great importance on the protection of your personal data and want to be transparent regarding how personal data is collected, processed and shared by us.

Personally Identifiable Information refers to any data that can be related to you as a person and processing refers to all our handling, including the use of it, storage and possible 3rd party transfer.

This privacy policy covers our relationship with customers and potential customers including marketing activities.

The policy may be updated from time to time and you will always find the latest version on our web sites. If we make a major update that impacts how we handle data in the future, we will notify you by the email address we have registered or notify you when using our webservices.

Personal information we collect and process about you

We collect and process data relating to you, based upon your consent or as permitted or necessary to perform a contract or based on the legitimate interests of HMS Industrial Networks. Our primary purpose in collecting information is to provide you with a safe, smooth, efficient and customized experience.

Information types and reason for collection

  • Q: To deliver products or services you order

    Processing of personal data is a necessary to enter into a contract and deliver products or services to you as well as handle warranty and payments.

    We collect your company name, contact details, payment and products ordered information. If you use our on-line services related to this, your IP number will also be stored.

    The data collected during order handling can also be used to contact you regarding products updates and advisories, HMS customer surveys and marketing of new products and services.

    If you do not want to receive such information you can ask us to block delivery by contacting us.

    We will store your data for seven years after your last contact with us, it will then be erased at the end of that year.

    In addition, economic transaction data will be archived according to the legal requirements for bookkeeping and taxes, in general for maximum ten years + current year.

  • Q: Talk2M and Argos cloud services

    When using our cloud services, we process information in the following categories:  

    • Identification data (name, address, telephone, phone number, email address, company name)
    • Accounting data (user name, account name)
    • List of your devices (like Flexy/Cosy/CD/Netbiter)
    • Traffic metadata (including: the duration of the connection, the number connection and the eWON device called and other similar metadata)
    • Credentials (password, hint password)

    We will process your data as long as you have an active service account. If there has not been any traffic associated to the account for seven years, the account and any associated data will be permanently deleted.

    We process this information to be able to provide the services as defined in the terms of usage and to develop and maintain our services.

  • Q: Customer relationship management

    To deliver excellent services and provide you with quotations etc. we use a customer relationship management system. In this system we process your contact information, our activities (phone calls, emails, visits etc.) and what kind of information you want to receive.

    We base this process on legitimate interest and keep this information for seven years from the last activity.

  • Q: Technical support and RMA handling

    To provide you with customer support we process your contact details, information about the product or service supported and other information you may submit related to the support case.

    To efficiently follow up on your cases we keep this data for seven years after last contact, after this period we may keep general support information to improve our products and solutions but will remove any information that can be linked to an individual.

    We base this process on legitimate interest or contractual requirement in case the product is under warranty.

  • Q: Marketing communication from HMS

    We will send you marketing information if you are a customer, have actively signed up to receive email marketing or otherwise showed clear interest in HMS and our products and services, for example, at fairs or seminars. We may also get address information from marketing partners that provide addresses to relevant companies.

    For statistical purposes we use web beacons in our marketing emails to measure if the email is opened, the links that are followed together with date and time.

    You can say no to further marketing information at any time by clicking the unsubscribe link in the footer of the email you receive from us. You can also say no to further marketing activities by contacting us at the address at the end of this policy. You have the possibility to say no to specific communication channels (phone, e-mail, fax etc.)

    We base our processing for marketing purposes on legitimate interest or by your consent when you sign up on mailing lists or otherwise show clear interest in our products.

  • Q: Customer surveys

    To enhance our offering, check trends and your overall satisfaction with HMS and our product and services, we do customer surveys from time to time.

    If not otherwise mentioned, we will store your contact information together with your answers to be able to follow up on you if necessary.

    We will send you surveys based on legitimate interest and you provide for answers based on your consent to participate.

  • Q: Attendance to events (seminars, trainings etc.)

    If you attend our seminars, presentations or training workshops arranged by HMS, on-line or at location, we will store your contact information for follow up and for marketing activities.

    Events may be recorded, should this be the case participants will be notified.

    In case food is provided we may ask for specific food preferences, this information can be sensitive and is only processed if required for the arrangement of the event and is then deleted.

  • Q: On-line forums and social media activities

    If you submit information to our on-line forums or social media accounts managed by HMS, you provide this information based on your consent for us to process it. We ask you to not post any information that can be related to any third person.

  • Q: When you visit our webpages

    When you visit our webpages, we automatically collect some technical information on the web server:

    Name of the file accessed, date and time of access, amount of data transmitted, notification of successful access, web browser, requesting domain and the public IP addresses of the requesting computer.

    We store this information based on legitimate interest only to be able to detect misuse or technical problems. The server logs are stored for six months.

A cookie is a small text file that’s stored on your computer or mobile device when you visit a website. We use cookies on our websites and platforms.

    First party cookies
    These are set by the website you’re visiting. And only that website can read them.In addition, a website might use a separate company to analyze how people are using their site. And this separate company will set their own cookie to do this.

    Third party cookies
    These are set by someone other than the owner of the website you’re visiting.
    Some HMS websites and pages may also contain content from other sites such as: YouTube, which may set their own cookies. Also, if you Share a link to an HMS website page, the service you share it on (e.g. LinkedIn/Facebook) may set a cookie on your browser. HMS Industrial Networks has no control over third party cookies.

    Advertising cookies
    Some websites use advertising networks to show you specially targeted adverts when you visit. These networks may also be able to track your browsing across different sites. HMS does not set or use advertising cookies.

    Session cookies
    These are stored while you’re browsing. They get deleted from your device when you close your browser e.g. Internet Explorer, Chrome, Firefox or Safari.

    Persistent cookies
    These are saved on your computer, so they don’t get deleted when you close your browser. We use persistent cookies when we need to know who you are for more than one browsing session. For example, not showing our Cookie Disclaimer banner each and every time, you visit after you have accepted.

  • Q: On our main websites

    ASP.NET_Session:
    Contains your session ID. Preserves the visitor's session state across page requests. These cookies let you use all the different parts of the website. Website functionality may be limited without this cookie.

  • Q: eWON Tech forum website

    Here is the list of cookies we enforce on the tech forum website which could be directly associated to you:

    • sid: The ID of your session.
    • mybbuser: Your user ID and login key, used to keep you logged in.       
    • mybb[lastvisit]: When you last visited the forum.        
    • mybb[lastactive]: When you were last active on the forum.        
    • mybb[threadread]: The threads you have read.        
    • mybb[forumread]: The forums you have marked as read.        
    • mybb[readallforums]: Whether all forums were marked as read.        
    • mybb[announcements]: Which announcements you have read.        
    • mybb[referrer]: The ID of the user who referred you to the forum, used if you register.        
    • forumpass: The passwords of password protected forums.        
    • mybblang: Which language you have chosen from the language selector.        
    • mybbtheme: Which theme you have chosen from the theme selector.       
    • collapsed: Which forum categories you have collapsed on the forum home page.        
    • coppauser: Whether you are a COPPA user when registering.       
    • coppadob: Your date of birth if you are a COPPA user.                
    • multiquote: Which posts you have chosen to multiquote.        
    • pollvotes: Tracks poll votes.     
    • mybbratethread: Which threads you have rated to prevent rating the same thread twice.

  • Q: Talk2M web application

    The Talk2M M2Web application requires several cookies to be enforced on your system in order to work as expected. Here is the list of cookies used by the application:

    • m2websession: It contains your session ID, used to identify you during the lifetime of a session on M2Web. It is also used for billing purpose.
    • m2webskin: It contains the M2Web skin unique ID, used to display the right skin on M2Web.
    • m2web.token: Session token used to identify a session established to an eWON device.
    • JSESSIONID: Unique session ID used to identify the user when a VNC/RDP session is established.
  • Q: Argos web application

    Strictly necessary cookies

    • JSESSIONID: it's used for authentication purpose.
    • JSESSION_AUTH: It's used for authentication purpose on our frontend services.
    • AWSALB: It’s used to redirect the user to the right server.
    • Google maps cookies: Are created by Google Maps itself and are used for the maps in Frontend. They are used both in Management and Presentation map view.

    Functionality cookies
    • HelpWizardLang: Is set to a language variable to remember the language for the "Step-by-step guides".
    • HelpWizardStep: Is to remember which step the user are on in the "Step-by-step guides", so it can stay open if the user move to another page.
    • HelpWizard: It is used to remember which page within the "Step-by-step guides" the user is on.
    • ShowInfoText: It is used to remember if the user has opened the help sometime or not.
    • CookieNotice: It is used to remember that the user has seen the cookie pop up information or not on the log in page.

    Other

    • Scayt_verLang: It is used by the user custom page editor to remember the user selected language.
  • Q: Third party statistical Cookies

    Our websites uses Google Analytics and Google Tag Manager, a web analytics service provided by Google, Inc. (“Google”).  Google Analytics cookies below are placed on your computer, to help the website analyze how users use the site. An example, How many visitors, pageviews, how many brochure downloads or video views, etc etc.

    The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States. Google will compile this information for HMS for evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage.

    Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google.

    No personal information (Name, Email, Age, Gender etc.) is sent from this website to Google. As an additional security feature, this website uses Google’s "IP Anonymization" feature so that no visitors full IP number can be obtained by Google.

Sharing and storage procedures

  • Q: How we share your data

    To be able to complete our services, we may transfer your data to external parties, where they are the responsible data controller, this includes:

    • Address and contact information to transportation companies to deliver your order.
    • Your contact details with contracted distributors to sell our products, respond to your product requests, organize marketing or promotional operations, contests, games and similar events; and fight against fraud.
    • Invoicing information, like data usage, to an HMS Distributor when we sell to you via such channel.

    We will never sell your information to any third party but can process your information within the HMS group globally.

    Please be informed that, notwithstanding the abovementioned, in the event of a designated authority lawfully requesting HMS Industrial Network to retain and provide personal data, communications content and/or traffic data, we will provide all reasonable assistance and information to fulfil this request.

  • Q: External data processors

    We use external data processors to provide us with different services, including:

    • IT service providers (Hosting, back-up, cloud solutions etc.)
    • Marketing partners (Surveys, e-mailing etc.)
    • Services to handle payments, like credit cards

    These service providers are only allowed to process information on behalf of HMS and as specifically instructed by us.

  • Q: Protection of your data

    It is important for us that your data is safe. We use up-to-date data protection mechanisms and have a good security posture.

    HMS Industrial Network entities ensure due care and take appropriate organizational and technical measures to protect the confidentiality and integrity of the personal data and communication data provided, collected and/or stored on our systems and shall not retain it any longer than permitted in order to perform its services or as required under relevant legislation.

    Your personal and communication data can only be accessed by authorized employees of HMS Industrial Networks that need to have access to this data in order to be able to fulfil their given duties.

  • Q: Data storage and location

    Your information may be stored and processed in any country in which HMS Industrial Network maintain facilities, including outside of the European Economic Area (EU, Norway, Liechtenstein and Iceland).

    We only make such transfer if the recipient of the data is located in a country which provides an adequate level of protection following a European Commission adequacy decision or if appropriate safeguards as within the EU have been provided HMS Industrial Network by executing standard contractual clauses.

    You have the right to know what information we process about you and the right to have your information corrected or deleted unless we have a legal duty to keep it. You also have the right of data portability.

    You can withdraw your consent for processing at any time. Please note that such withdrawal will not affect the lawfulness of processing based on your consent before the withdrawal.

Within a reasonable period of time and upon verification of your identity and to the extent your request is legitimate, we will fulfil your request, provided we will not act contrary to applicable legislation by fulfilling your request.
